Custom Design Project Development

Consultation:  Your consultation serves as a complimentary starting point to discuss initial design ideas, budget, timeline, and any other details. Consultations can be conducted in-person, over email, or virtually via Zoom. Book your consultation by contacting us through the contact form.

Materials Deposit:  For custom jewelry involving materials like chains, stones, or sample textures brought in, a $250 non-refundable deposit is required, deductible from the final total. 

Cancellation Policy:  Please note, we require a 24-hour notice for any consultation cancellations or rescheduling.

Estimates:  Depending on project complexity, estimates will be provided within a week to ten days after the consultation. Variations may occur due to current gold prices, materials availability, or design changes.

Custom Design and Client Provided Stones

Sizing and Design Feedback: It is the Client’s responsibility to provide accurate sizing information. Timely Client feedback on design is crucial. Delays in feedback may result in a revision of the delivery schedule at the Jeweler’s discretion.

Client Provided Gemstones: Client-provided gemstones may be accepted at MJD’s discretion. Approval for the use of pre-owned or already purchased stones is determined on a case-by-case basis during the design process.

Risk and Liability: If the Client chooses to mail or hand-deliver a gemstone or jewelry containing a gemstone, they accept full responsibility for any shipping costs, loss, or damage incurred during transit. MJD acknowledges the inherent risk involved in removing stones from mountings and resetting them. Prior to proceeding with stone resetting, MJD will assess risks and inform the Client of any potential issues. MJD shall not be held responsible for broken or cracked gemstones or diamonds under any circumstances.

Consent and Release: By providing consent for MJD to reset a pre-existing gemstone or refine metal, the Client releases MJD from any liability for damages that may occur during the process, including those caused by third parties. This includes damage due to stone flaws, existing cracks, chipping, or inclusions discovered during resetting. These policies ensure clarity and mutual understanding regarding the handling of client-provided gemstones and the risks associated with custom jewelry services. Reusing or Crediting Metals: Customers will receive credit equivalent to the prevailing scrap metal prices at the time of return or exchange. The value of the metal will be determined based on its type and weight, following industry-standard practices for scrap metal valuation.Credits will be issued in the form of company credit, refund, or another agreed-upon method. We will only accept yellow gold for recycling purposes. This includes any gold items or materials returned to us by customers or acquired through other means. All yellow gold received will be assessed based on its purity and weight to determine its recycling value. Any additional gold beyond the customer's recycled yellow gold will be charged at market value.

Stone Viewings: Our policy allows customers the option to view stones before finalizing their purchase. To facilitate this process, customers must place a $500 deposit. They will have a period of 10 days from the procurement of the stones to view them.

Production and Payment

Production Timeline: After design approval, production will begin. Jewelry production typically takes 3 to 6 weeks from the approval date. MJD will inform you of any timeline issues Rush orders may be possible with additional charges.

Completion and Pickup: Upon completion, you'll be notified for pickup within 30 days. Please pick up promptly, as we are not liable for items left beyond 30 days.

Resizing and Care: All custom jewelry sales are final. Customers who purchase custom-designed rings from Mosette Jewelry are eligible for one complimentary sizing within 6 months of receiving the ring. This complimentary service covers standard adjustments and is provided at no additional cost to the customer. This policy only applies to custom designed rings.

Legal and Additional Information

Terms of Purchase: By proceeding with your purchase, you agree to our Terms of Purchase, which outline payment schedules, delivery terms, and other important details.

Disclaimers: We do not guarantee exact appearance due to natural variations in jewelry design. Custom pieces are non-refundable and final sale.

Legal Terms: All disputes are subject to arbitration per the laws of Pennsylvania. The entire agreement between parties is reflected in these policies.

Repairs and Warranty Policy

Repairs: Clients who purchase custom jewelry from MJD are entitled to complimentary repair services for any damages to purchased items within six months, subject to the following conditions:

- Damage must not result from unusual or extreme wear or use, including but not limited to incidents such as loss in drain disposal, catching on objects, impact with surfaces, loss at sea, or damage caused by acts of nature or other human tools.

- MJD retains sole discretion to assess the extent of damage and may apply additional fees as deemed appropriate.

Exclusions: This warranty does not cover the loss or theft of Jewelry, either partially or entirely. It also does not provide for replacement of center stones under any circumstances, regardless of how the stones were lost, misplaced, or damaged. Additionally, the warranty does not apply if the jewelry has been altered or resized by a third party without MJD’s express written authorization.

Appraisals and Insurance: MJD will provide a complimentary appraisal of the jewelry. It is the Client's responsibility to obtain insurance coverage for the jewelry promptly to protect against theft, loss, or damage.

Intellectual Property Rights: All intellectual property rights, including copyright, associated with the design and branding created for the Client by MJD, remain with MJD. MJD reserves the right to use photographs of the design and final product for promotional, display, advertising, internet use, or publication purposes, unless otherwise revoked by the Client.

Disclaimers & Release of Claims: By purchasing or using the jewelry, the Client acknowledges that MJD is not liable for any direct or indirect adverse effects or consequences that may arise. Due to the nature of jewelry design, variations from the expected appearance may naturally occur, which are not considered defects or damages. MJD is released from all claims related to interruptions, misinformation, or any other losses.

Force Majeure: If circumstances beyond reasonable control, such as acts of nature, war, terrorism, or pandemic, prevent either party from fulfilling obligations under this Agreement, performance shall be extended without liability during the period of delay or inability to perform.

Good Faith: Both parties affirm that they have acted and will continue to act in good faith throughout the negotiation, execution, performance, and termination of this Agreement.

Limitation of Liability: Under no circumstances shall MJD be liable for direct, indirect, incidental, consequential, special, punitive, exemplary, or any other damages arising from the use of the jewelry. In states where such limitations are not permitted, liability is limited to the fullest extent permitted by law, not exceeding $100.

Governing Law: This Agreement shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, irrespective of conflict of laws principles.

Entire Agreement: This Agreement constitutes the entire understanding between the parties, superseding all prior agreements, whether oral or written.
